These Terms of Service (“Terms”) govern access to and use of the website healthylyfe.fit and the HealthyLyfe™ mobile application (together, the “Services”), operated by HealthyLyfe (“HealthyLyfe,” “we,” “us,” or “our”). By using the Services, you agree to these Terms.
1. Eligibility
You must be at least the age of majority in your jurisdiction (and at least 13 years old, or 16 where higher age is required by local law) to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
2. Accounts and registration
You may need an account to access certain features. You agree to provide accurate information and keep credentials confidential. You are responsible for activity under your account. Notify us promptly of unauthorized use. We may suspend or terminate accounts that violate these Terms or pose security risk.
3. License to use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial fitness and wellness purposes unless we agree otherwise in writing.
4. Acceptable use
You agree not to:
- Violate any law or third-party rights;
- Harass, abuse, defame, threaten, or discriminate against others;
- Upload malware, scrape or overload our systems, or attempt unauthorized access;
- Reverse engineer, decompile, or circumvent security or usage limits except where prohibited by law;
- Use the Services to build a competing product using our data or interfaces without permission;
- Misrepresent your identity, credentials, or professional qualifications (including trainer status where applicable).
5. Health, fitness, and medical disclaimer
Not medical advice. The Services provide fitness, nutrition, and wellness information and tools for general educational and self-tracking purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting or changing an exercise program or diet, especially if you have medical conditions, injuries, are pregnant, or take medications.
Assumption of risk. Physical activity carries inherent risk. You voluntarily assume all risks associated with exercise and nutrition choices you make based on or tracked through the Services.
6. AI-generated content
Features that use artificial intelligence may produce inaccurate, incomplete, or inappropriate outputs. AI recommendations are informational only and not tailored medical or professional advice. You are responsible for how you use AI outputs. We may log or monitor usage as described in our Privacy Policy to improve safety and quality.
7. Trainers, coaches, and third parties
If the Services help you discover or work with trainers or other professionals, those individuals are independent of HealthyLyfe unless expressly stated. We do not guarantee their qualifications, availability, or advice. Your relationship with any trainer is directly between you and that provider; review their credentials and agreements carefully.
8. User content
You may post or upload content such as profile information, posts, photos, comments, or messages (“User Content”). You retain ownership of your User Content. You grant HealthyLyfe a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), display, and distribute User Content solely to operate, promote, and improve the Services and as required by law.
You represent that you have all rights necessary to grant this license and that your User Content does not violate third-party rights or these Terms. We may remove content that violates these Terms or law.
9. Intellectual property
The Services, including software, branding, text, graphics, and documentation, are owned by HealthyLyfe or our licensors and protected by intellectual property laws. Except for the limited license above, no rights are granted. HealthyLyfe™ and related marks are trademarks of their owner; unauthorized use is prohibited.
10. Subscriptions, fees, and trials
If we offer paid plans, pricing, billing cycles, renewal, and cancellation terms will be presented at purchase. Taxes may apply. We may change fees with reasonable notice where required. Free trials convert to paid subscriptions only as disclosed at signup.
11. Third-party services
The Services may link to or integrate third-party apps, wearables, or websites. Their terms and privacy policies govern your use of those services. We are not responsible for third-party content or practices.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT DEFECTS WILL BE CORRECTED.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEALTHYLYFE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW (SUCH AS GROSS NEGLIGENCE OR WILLFUL MISCONDUCT).
14. Indemnity
You agree to indemnify and hold harmless HealthyLyfe and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Services, or your violation of these Terms or law.
15. Termination
You may stop using the Services at any time. We may suspend or terminate access for conduct that violates these Terms, creates risk, or for operational reasons. Provisions that by nature should survive (including disclaimers, limitations of liability, indemnity, and dispute terms) will survive termination.
16. Governing law and disputes
These Terms are governed by the laws of the United States and the state where HealthyLyfe maintains its principal place of business, without regard to conflict-of-law rules. You agree that courts in that state have personal jurisdiction, except where consumer protection law requires otherwise. Contact us through the method in the Contact section below before initiating formal proceedings; we will try to resolve concerns informally. Nothing in this section limits your rights under mandatory consumer protection laws in your jurisdiction.
17. Changes to these Terms
We may modify these Terms by posting an updated version on healthylyfe.fit or the app and updating the “Last updated” date. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Services. Material changes may require additional notice under applicable law.
18. Miscellaneous
These Terms constitute the entire agreement regarding the subject matter here. If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale.
